LOCKPORT – A Lockport man arrested in an Aug. 24 drug raid at an apartment on Niagara Street was given 24 months of interim probation, but could face up to nine years in prison if he violates mandatory drug court.
Mark D. Kahle, 43, of Bonner Drive, pleaded guilty to the top charge, third-degree criminal possession of a controlled substance, Tuesday in Niagara County Court, and admitting to Niagara County Court Judge Sara Sheldon Farkas that he was in possession of cocaine with the intent to sell the drug.
Kahle was ordered to follow the terms of probation and complete the drug court program.
She said if he succeeded, the charge would be lowered to seventh-degree criminal possession and he could be sentenced to probation or have the charges dismissed when he returns on Jan. 7. But if he fails, he would face one to nine years in prison and an additional one to two years post release supervision, Farkas said.
